Welcome to Mechanic's Ear. These Terms of Service ("Terms") govern your access to and use of the Mechanic's Ear mobile application and related services (collectively, the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE APP. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

1. Acceptance of Terms

By creating an account, accessing, or using Mechanic's Ear, you agree to:

• Be bound by these Terms of Service
• Comply with our Privacy Policy
• Be at least 18 years old or have parental/guardian consent
• Provide accurate and complete information
• Use the App in compliance with all applicable laws and regulations

2. Description of Service

Mechanic's Ear is a diagnostic information tool that provides:

• OBD2 diagnostic code explanations and descriptions
• Vehicle information and recall lookups via NHTSA database
• Bluetooth OBD2 scanner connectivity
• Maintenance tracking and service history logging
• Cost estimates for common repairs
• Educational content about vehicle diagnostics
• Product recommendations through affiliate partnerships

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account by providing:

• Valid email address
• Secure password
• Any additional required information

3.2 Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring the accuracy of information you provide

3.3 Account Security

You must not:

• Share your account credentials with others
• Create accounts using false or misleading information
• Create multiple accounts to circumvent restrictions
• Use another person's account without permission

4. Subscription Services

4.1 Subscription Plans

Mechanic's Ear offers various subscription tiers with different features and pricing. Current subscription options are displayed in the App and may be updated from time to time.

4.2 Free Version

The free version of the App includes:

• Limited number of monthly code lookups
• Advertising
• Access to basic features

4.3 Paid Subscriptions

Paid subscriptions provide:

• Unlimited code lookups
• Ad-free experience
• Premium features as described in the App
• Priority customer support

4.4 Billing and Payment

• Subscriptions are billed through your Apple App Store or Google Play Store account
• Payment is charged upon purchase confirmation
• Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Prices are subject to change with notice

4.5 Cancellation

• You may cancel your subscription at any time through your App Store or Google Play account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods
• You retain access to premium features until the end of your paid period

4.6 Refund Policy

• Refunds are handled by Apple App Store or Google Play Store according to their policies
• We do not process refunds directly
• Contact Apple or Google customer support for refund requests
• Refund eligibility is determined by their respective policies

5. Acceptable Use

5.1 Permitted Use

You may use the App for lawful, personal, non-commercial purposes to:

• Diagnose and understand vehicle issues
• Track vehicle maintenance
• Learn about automotive systems
• Research repair costs and options

5.2 Prohibited Use

You may NOT:

• Use the App for illegal purposes or to violate any laws
• Reverse engineer, decompile, or disassemble the App
• Copy, modify, or create derivative works of the App
• Sell, rent, lease, or sublicense access to the App
• Remove or alter copyright notices or trademarks
• Use automated tools to access or scrape data from the App
• Interfere with or disrupt the App's functionality
• Upload malicious code, viruses, or harmful content
• Impersonate others or misrepresent your affiliation
• Harass, abuse, or harm other users
• Use the App to provide commercial diagnostic services to others

6. Disclaimers and Limitations of Liability

6.1 No Professional Advice

Mechanic's Ear provides general information and educational content only. The App:

• IS NOT a substitute for professional automotive diagnosis or repair
• DOES NOT provide professional mechanical advice
• DOES NOT guarantee the accuracy of cost estimates
• DOES NOT endorse specific repair facilities or products (except where disclosed as affiliate relationships)

6.2 Use at Your Own Risk

You acknowledge and agree that:

• Vehicle diagnosis and repair involve inherent risks
• You use the App and any information provided entirely at your own risk
• You are solely responsible for decisions about your vehicle
• We are not responsible for any consequences of actions you take based on information from the App

6.3 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of information
• Uninterrupted or error-free operation

6.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MECHANIC'S EAR, ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any vehicle damage resulting from use of the App
• Personal injury or property damage of any kind
• Incorrect diagnostic information or code explanations
• Costs of repairs or services
• Lost profits, revenue, or business opportunities
• Indirect, incidental, special, consequential, or punitive damages
• Data loss or corruption

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM (OR $50 IF YOU USED THE FREE VERSION).

6.5 Third-Party Information

The App may display information from third-party sources including:

• NHTSA vehicle and recall data (government database)
• Aftermarket product information
• User-generated content

We do not control or verify third-party information and are not responsible for its accuracy or reliability.

7. Intellectual Property

7.1 Our Rights

All content, features, and functionality of the App, including but not limited to:

• Software code and architecture
• OBD2 code database and explanations
• Graphics, logos, and design elements
• Text, images, and audiovisual content
• Trademarks and service marks

are owned by Mechanic's Ear or our licensors and are protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7.3 User Content

You retain ownership of content you create in the App (maintenance logs, notes, etc.), but grant us a worldwide, non-exclusive, royalty-free license to use, store, and process such content to provide the App's services.

8. Affiliate Relationships

Mechanic's Ear participates in the Amazon Associates program and may display affiliate links to products. When you:

• Click on Amazon product links in the App
• Make a purchase through these links

We may earn a small commission at no additional cost to you. These commissions help support the development and maintenance of the App.

Product recommendations are made in good faith to provide helpful information, not to pressure you into purchases.

9. Advertising

The free version of the App displays advertisements through Google AdMob. By using the free version, you consent to the display of ads. Advertising practices are governed by:

• Google AdMob's policies and terms
• Our Privacy Policy
• Applicable advertising regulations

10. Modifications to the App and Terms

10.1 App Changes

We reserve the right to:

• Modify, suspend, or discontinue the App or any features at any time
• Update subscription pricing with notice
• Change feature availability across subscription tiers

10.2 Terms Changes

We may modify these Terms at any time. Changes will be effective when posted, and we will notify you through:

• In-app notification
• Email to your registered address
• Updated "Last Modified" date at the top of these Terms

Your continued use after changes constitutes acceptance of modified Terms.

11. Termination

11.1 Termination by You

You may terminate your account at any time by:

• Deleting your account through the App settings
• Uninstalling the App
• Contacting us at [email protected]

11.2 Termination by Us

We reserve the right to suspend or terminate your access immediately, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the App or other users
• Non-payment of subscription fees
• Any reason at our sole discretion

11.3 Effect of Termination

Upon termination:

• Your access to the App will cease immediately
• Your data may be deleted according to our retention policy
• Subscription payments will not be refunded
• These Terms' provisions regarding liability, disclaimers, and intellectual property will survive

12. Indemnification

You agree to indemnify, defend, and hold harmless Mechanic's Ear, its owners, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any law or rights of third parties
• Actions you take based on information from the App
• Vehicle repairs or modifications you perform

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mechanic's Ear regarding use of the App.

13.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your account. We may assign our rights and obligations without restriction.

• The App is an informational tool, not professional advice
• You use the App at your own risk
• We are not liable for vehicle damage or personal injury
• You should always consult a professional mechanic for vehicle issues
• You are responsible for all actions you take based on information from the App
